Asbestos Control ProgramReal Estate DisclosureWhen buying or selling a home, consumers frequently have questions regarding building materials that may contain asbestos. Neither the RI Asbestos Act (Title 23-24.5) or the RI Rules and Regulations for Asbestos Control (R23-24.5-ASB) prohibit the sale of a property that contains asbestos. However, because of the potential health effects of exposure to asbestos fibers, it is recommended that homebuyers determine if asbestos containing building materials are present. Title 5 Chapter 20.8 of the RI General Laws requires disclosure of owner’s knowledge of deficient conditions, including hazardous materials as asbestos in certain real estate transactions. You should discuss this requirement with your real estate agent, or contact the RI Department of Business Regulation at (401) 222- 2255. If you purchase a home that contains asbestos building materials that are damaged, or that you plan on removing, please visit our Homeowner Information page for guidance. Asbestos containing building materials may be considered damaged if they are worn, peeling, cracking, crumbling or in otherwise deteriorated condition. Friable asbestos containing building material (material that when dry can be crumbled, pulverized or reduced to powder by hand pressure) is of greater exposure risk than non-friable material.
