HEALTH DEPARTMENT WARNS RETAILERS: DON’T SELL TOBACCO PRODUCTS TO KIDS

Providence. The Rhode Island Director of Health issued an advisory to Rhode Island tobacco merchants to comply with Food and Drug Administration (FDA) regulations which prohibit the sale of tobacco products to anyone under age 18. The advisory comes on the heels of a decision by the U.S. Court of Appeals that the FDA has no jurisdiction over tobacco products. The U.S. Government is seeking review of this decision.

"According to the FDA, the current regulations remain in force pending the appeal," stated Dr. Patricia Nolan, Rhode Island Director of Health. "Even the majority opinion of the Court conceded that tobacco is addictive, it’s dangerous and that it fits the definition of a ‘drug.’ In her communication with retailers, Dr. Nolan encouraged them to comply with the federal regulations that seek to protect youth from tobacco use.

Pending a final outcome, the Department of Health will carry through on the enforcement of FDA restrictions in effect since February 1997. These regulations prohibit retailers from selling cigarettes and smokeless tobacco to persons younger than 18 years of age and requires merchants to check photo IDs of customers under the age of 27.

Every day 3,000 young people in the United States become regular smokers, 1,000 of those will die early of tobacco related disease. Dr. Nolan reminded retailers of the vital role they play in protecting children and youth from the risk of nicotine addiction and premature death associated with tobacco. "This advisory should clarify any questions about the legal situation," said Dr. Nolan "Your attention to tobacco sales requirements is greatly appreciated."
